As a Brand Rep, you understand and agree to the following terms and conditions:

It is not necessary for you as the Brand Rep to have signed any document for these terms and conditions to apply.

 

Please read these terms and conditions carefully:

 

  • As a Brand Rep you are not an employee, agent, franchisee, or partner of the company. You cannot act on behalf of the company. You do not have any authority to incur debt, obligation, or liability on behalf of the company.

  • As a Brand Rep you will promote and market products/services to customers via social networks and word of mouth.

  • As a Brand Rep you will promote products/services on social media accounts by posting appropriate content. You will contact the company if a clear understanding of “appropriate” content is needed. You will not receive any financial or other compensation for product promotion through your social media network.

  • As a Brand Rep you understand that you have permission to repost an existing post by the Official Pamper Lounge social media accounts.

  • As a Brand Rep you will conduct yourself in a manner that reflects the highest standard of integrity and responsibility in keeping with the reputation of the company. If you do not uphold these standards, you will be immediately removed from the Brand Rep program and forfeit any unused gift cards/free services/products and all promotional codes will be ineffective immediately.

  • As a Brand Rep you will not receive any cash value for any unused free products/services you will receive as a perk of being a Brand Rep.

  • As a Brand Rep you will receive 25% discount on any products when placing an order online or in salon using your exclusive Brand Rep promotion code that was sent to you.

  • As a Brand Rep - Commission is paid every 4 weeks into the bank account stated on your registration form starting from 12th February 2021 and you will receive a commission report to view your progress via email. (unless other arrangements have been made and agreed upon)

  • As a Brand Rep – it is your responsibility to inform the customer that your unique promo code must be entered upon checkout to enable you to receive commission on a sale. No exceptions will be made and if any orders are submitted without using the selected promotion code, no cash compensation will be provided by the company to either you as a Brand Rep or the customer. Only one promotion code can be applied per order.

     

  • As a Brand Rep you are not permitted to share your Brand Rep promotion code (25% discount code) with anyone else. No exceptions.

  • As a Brand Rep you will not sell company products/services on unauthorized websites on the internet or in retail establishments.

  • The Pamper Lounge (N. Yorks) Ltd is not responsible if information made available on this site is not accurate, complete or current.

     

  • The material on this site is provided for general information only and any reliance on the material on this site is at your own risk.

     

  • As a Brand Rep you agree that it is your responsibility to monitor changes to our site.

     

  • If you choose to leave the Brand Rep program... any photos sent to The Pamper Lounge, employee or director will remain in our database to use on our social media platforms and marketing campaigns.

     

  • If the company terminates the Brand Rep program, all perks (promotional codes etc) will cease immediately.

     

  • Prices for our products and services are subject to change without notice. We reserve the right to modify or discontinue the service/product without notice at any time. The Pamper Lounge (N. Yorks) Ltd shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the service/product.

     

  • As a Brand Rep you must have permission to share/download photos from other Brand Reps Social Media accounts – if you do not have permission to share you will be breaching copyright law.

     

  • In the consequence of refunds, cancellations, or default of payment for any orders that have been placed using your unique promo code for either a product, service or event - the commission gained from the sale will be deducted from your next commission report/payout or if no commission has been gained during the most recent period you will be liable to pay back any commission paid after the date of the default payment or termination of payment.

     

  • Commission is not gained on shipping/postage paid by customers.

     

  • Subscriptions for any or products/services that are already in place by customers can not be transferred to your account to gain commission.

     

  • If a customer contacts you (as a Brand Rep) in person via social media or in any form - in regards to a complaint, damaged or missing goods - please be aware that you do have authority to deal with the complaint.   • If you have been informed by a customer that an order has been placed using your promo code however, the commission report does not show proof of the order and commission. Please contact the company with the name of the customer and the order number, the order can then be located but please be aware that if the customer has placed an order but has not entered your unique promo code upon checkout, no commission will be paid for the order. No exceptions.

     

  • If a customer uses a gift card for full or partial payment for payment of services or products under no circumstances will discount be applied to the order or upon checkout in the salon and no commission will be received.

     

  • As a Brand Rep you do not not have permission to use customers names, reviews etc without written permission from the customer.

     

  • Please be aware that any discussions that take place on the Official Brand Rep group chat or private group is private, confidential and is a safe space. Do not breach data protection.

     

  • The Official Brand Rep group chat and private group can not be used to promote or sell any products or services.

     

  • You must be an active Brand Rep to remain in the program – an active Brand Rep must make an overall total of over £5 in sales in the first 3 months and £5 every 3 months therefore after. If this target has not been met you will unfortunately be immediately removed from the Brand Rep program and forfeit any unused gift cards/free services/products and all promotional codes will be ineffective immediately.

     

  • As a Brand Rep we do allow you to borrow products for exhibiting purposes however, a deposit will be required and if any damage occurs you will be charged. Further details will be provided in regards to exhibiting upon request.

     

  • Please be aware that all photos/videos obtained during any events virtually or in person, as a 'Company' we own all the rights and do not need to obtain your permission to use for marketing purposes.

     

  • As a Brand Rep you can not review or recommend any other products/services on behalf of the company 'The Pamper Lounge (N. Yorks) Ltd' other than the products/services advertised on our website or in salon.

  • As a Brand Rep you can not endorse/recommend any external companies on behalf of The Pamper Lounge (N. Yorks) Ltd. 

  • As a Brand Rep you can not act or advise on behalf of The Pamper Lounge (N. Yorks) Ltd.

     

  • The use of your unique promo code in salon, enabling customers to receive 5% discount applies to our set packages/courses/block bookings and set party packages only. You will earn 20% commission on the above. Individual treatments are not included and the unique promo codes can not and will not be accepted/applied under any circumstances. Treatments/services provided at Sutton Hall or any treatments offer by a self employed person is excluded from commission/discounts.

  • Other opportunities will be available to gain commission on selected retreat days, special offers and events upon on authorisation. When this commission is available to gain, you will be updated via the Brand Rep Group Chat or Private Group.

  • As a Brand Rep you will receive 25% discount off your own treatments in salon, this discount cannot be used by friends and family under any circumstances and no exceptions will be made.

  • Your unique promo code can be used by customers in salon for products, there is no limit to how many times the customer can use. The customer must quote your code upon checkout. If the customer forgets to quote upon checkout, no discount will be applied and no commission will be paid for the sale. No exceptions.

  • No discount codes apply to the purchase of gift cards either as a Brand Rep or customer. If a code is applied and a sale is processed, a refund will be processed.

     

  • As a Brand Rep you will not be treated as a company employee for any reason.

  • On the sale of a subscription box using your unique promo code – as a Brand Rep you will receive commission every month for the monthly subscription payment until the subscription ends or is cancelled.

     

  • Occasionally we may share information with you that is confidential in nature, such information will be identified as confidential and you are expected to maintain this information in the strictest confidence. Any disclosure of confidential information will terminate this agreement and result in legal action.

     

  • You agree to hold The Pamper Lounge (N. Yorks) Ltd as a company, its directors, agents, assignees and employees harmless for any liability from any injury or damage arising from the use or promotion of any free product or service received during the programme.

  • As a Brand Rep you agree that you will not post content on any social media platform, as determined by The Pamper Lounge (N. Yorks) Ltd in its sole discretion, that:

  1. is pornographic, sexually explicit or suggestive, or contains profanity or nudity;

  2. is unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group;

  3. make any false statements or claims about The Pamper Lounge (N. Yorks) Ltd products, employees, directors, services or other Brand Reps;

  4. speak negatively about The Pamper Lounge (N. Yorks) Ltd or any other supplement company;

  5. promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing);

  6. promote any activities that may appear unsafe or dangerous;

  7. is obscene or offensive, or endorses any form of hate or hate group;

  8. defames, misrepresents or contains disparaging remarks about other people or entities;

  9. communicates messages or images inconsistent with the positive images and/or good will with which The Pamper Lounge (N. Yorks) Ltd wishes to associate;

  10. violates any law.

  • Brand Reps who do not follow the requirements can be subject to termination, suspension or their free services/products or commissions being held until all requirements are followed.

  • You agree that The Pamper Lounge (N. Yorks) Ltd may post, re-post, upload, and otherwise re-use any of your content at any time, without compensation other than what is provided in the Brand Rep Terms.

  • You acknowledge and agree that you are responsible for:

  1. Any and all activity undertaken in connection with your participation in the program;

  2. Maintaining your accounts to ensure compliance with all applicable laws, rules, regulations and policies (collectively, the “Law”), including providing any notifications to followers as necessary to effect compliance with Law;

  3. Conducting yourself at all times with the highest degree of professionalism, behaving in a legal, ethical and business-like manner and maintaining the highest standards of integrity, honesty and responsibility in your dealings with The Pamper lounge (N. Yorks) Ltd, its staff, customers and other Brand Reps;

  4. Presenting and demonstrating The Pamper Lounge (N. Yorks) Ltd products or services in a positive, truthful and sincere manner and not engaging in any activity or action that may damage The Pamper lounge (N. Yorks) Ltd reputation or the reputation of its products or services;

  5. Not using The Pamper Lounge (N. Yorks) Ltd, or any trademarks, copyrighted materials, or other Intellectual Property of The Pamper Lounge in any advertising, social media, or in literature other than material published by The Pamper lounge (N. Yorks) Ltd, without first obtaining the express written permission of The Pamper Lounge (N. Yorks) Ltd; and

  6. complying with the Brand Reps terms and conditions.

  • The Pamper Lounge (N. Yorks) Ltd reserves the right to preview your content upon request and reserves the right to request changes to and/or removal of content in its sole discretion. We have the right to monitor your accounts at all times to ensure that your accounts comply with the terms, the law, and any other requirements. We may notify you of any changes to your content or accounts that we feel should be made. Without limiting our rights as stated herein, we may terminate your participation in the program if you do not make any changes to your account that we feel are necessary or appropriate. We reserve the right to terminate your participation in the program immediately and without notice to you should we suspect that you have committed fraud or otherwise violated the Brand Rep terms. If such fraud or abuse is detected, The Pamper Lounge (N. Yorks) Ltd shall not be liable to you for any commissions for such fraudulent sales.

  • Third Parties. The Pamper Lounge (N. Yorks) Ltd recognizes that, as an independent contractor, you are available to perform services for entities other than The Pamper Lounge (N. Yorks) Ltd. You agree to notify The Pamper Lounge (N. Yorks) Ltd of any other arrangements. Moreover, you warrant and represent that there is no conflict or potential conflict of interest between your performance of services under the Brand Rep terms and the performance of services under other contracts for services or as an employee of other entities and will ensure that no such conflict arises. Without limiting the foregoing, you agree to promptly notify The Pamper lounge (N. Yorks) Ltd if and when you are engaged to perform substantially similar services with respect to a competing brand of products.

  • Brand Rep commissions are counted and final numbers are deemed final at the sole discretion and decision of The Pamper Lounge (N. Yorks) Ltd. The Pamper Lounge (N. Yorks) Ltd also reserves the right to change the dates of the commission payout.

  • The Pamper Lounge (N. Yorks) Ltd shall not be liable in contract, tort (including negligence) or otherwise for any of the following losses or damages arising out of or in connection with The Pamper Lounge (N. Yorks) Ltd or the The Pamper Lounge (N. Yorks) Ltd Brand Rep program (including but not limited to the consumption and/or use of The Pamper Lounge (N. Yorks) Ltd products and services:
    (i) loss of profit;
    (ii) loss of business;
    (iii) loss of revenue;
    (iv) loss of goodwill or damage to reputation; or
    (v) any indirect, special or consequential loss or damage howsoever caused.

  • In regards to the Brand Rep discount code (25% code) - this code is not to be shared on public coupon/discount websites. If your code is discovered on a public coupon/discount websites without our written permission your affiliation with us will be terminated immediately and all commissions due will be cancelled and reviewed.

  • Either party may terminate this agreement immediately for cause or without reason upon written notice. The notice may be via email. Once this agreement has been terminated your affiliation with us 'The Pamper Lounge (N. Yorks) Ltd) will be terminated immediately and commission due to you up to the date of the termination will paid be paid on the next/upcoming commission date. Any commission due therefore after the final commission pay date such as monthly subscription payments etc... will ceased immediately and no further commission payments will be made. Both your unique discount code and Brand Rep code will become inactive immediately from termination.

  • You agree that The Pamper Lounge (N. Yorks) Ltd may post, re-post, upload and/ or use any and all of the content in its advertising, in emails, on its sales pages including, without limitation; website on social media outlets (including but not limited to the approved media) at its discretion, in perpetuity, with or without notice or compensation.

  • As a Brand Rep do not make any representations, claims or promises on behalf of The Pamper Lounge (N. Yorks) Ltd, other than those contained in The Pamper Lounge (N. Yorks) Ltd official marketing and promotional materials (i.e. on the label or The Pamper Lounge website);

  • You agree that any and all content, photos, videos, verbiage, pictures, writings, other work product and/ or works of authorship generated as part of the content or otherwise related to the promoting that you do for The Pamper Lounge (N. Yorks) Ltd (collectively, the “Content”) shall be the sole and exclusive property of The Pamper Lounge (N. Yorks) Ltd, and you irrevocably assign to The Pamper Lounge (N. Yorks) Ltd all right, title and interest in any content that you create, or to which you contribute, including all intellectual property rights contained therein.

  • As a Brand Rep you will protect the Company’s trademark by not reproducing the Company’s name/trademark or any company materials for use in advertising without the written approval of the Company.
